DECLARATION PERMITTING RE-OPENING OF BARS

WHEREAS, by virtue of Executive Order Number 25 JBE 2020, issued on March 11, 2020, Governor John Bel Edwards declared a Public Health Emergency for the State of Louisiana as a result of the outbreak of a respiratory disease caused by a previously unknown or nonexistent coronavirus which has now been named “coronavirus disease 2019″ (“COVID-19″);

WHEREAS, Executive Order Number 25 JBE 2020, imposed several measures deemed necessary at that time to address the Public Health Emergency;

WHEREAS, on March 13, 2020, Governor John Bel Edwards issued Executive Order 27 JBE 2020, which imposed additional measures related to the State of Emergency declared on March 11, 2020, all of which were designed to stymie the proliferation of COVID-19 and to protect the capability of the State’s health care system to provide needed services;

WHEREAS, on March 16, 2020, Governor John Bel Edwards announced further measures in addition to those contained in Executive Order 27 JBE 2020, all in an effort to establish enhanced measures necessary to adequately address COVID-19;

WHEREAS, Governor Edwards has amended the aforementioned executive orders all related to restrictions and other measures deemed by him to be appropriate;

WHEREAS, on September 11, 2020, Governor Edwards issued Executive Order 117 JBE 2020, which provides in Subsection B(3) hereof that bars shall remain closed for on premises consumption food or drinks;

WHEREAS, Subsection B(4) of Executive Order 117 JBE 2020 provides that an individual Parish may “affirmatively opt-in to allow on-premises consumption” of food and/or drinks should the said Parish in which the bar is located have a percent positivity of 5% or less for two consecutive weeks, all subject to the terms and conditions set forth in the subsection;

WHEREAS, the percent positivity rate for St. Martin Parish, Louisiana for the last two consecutive weeks has been less than 5% according to the data published by the Louisiana Department of Health;

WHEREAS, Parish President Chester R. Cedars does hereby issue the following declarations to permit the re-opening of the bars within St. Martin Parish, Louisiana:

BE IT KNOWN that the Honorable CHESTER R. CEDARS, St. Martin Parish President, does on behalf of St. Martin Parish, Louisiana, opt-in to allow on-premises consumption of food and/or drinks, all in accordance with the provisions of Subsection 3(a) of Executive Order 117 JBE 2020, as supplemented by Executive Order 123 JBE 2020:

BE IT FURTHER KNOWN that this edict and the re-opening of bars within St. Martin Parish shall be subject to all of the terms and conditions set forth in Executive Orders 117 JBE 2020, all as mandated by law, including but not limited to Subsection B(3) thereof, and as supplemented by Executive Order 123 JBE 2020.

BE IT FURTHER KNOWN that this declaration shall be subject to all other declarations previously issued by St. Martin Parish.

BE IT FURTHER KNOWN that this declaration shall be afforded prompt publicity by all reasonable means and filed with the Office of Clerk of Court for St. Martin Parish, the St. Martin Parish Office of Emergency Preparedness and Homeland Security, and Clerk of the Parish Council for St. Martin Parish, Louisiana, all pursuant to La. R.S. 29:727(D).
